Sell a Fire Damaged House in Over-the-Rhine and Downtown

This is the oldest and most tightly built part of the city, and it is where the difference between a wall that carries a building and one that merely faces it is worth the most money.

A Surviving Shell Is a Real Asset

Where masonry genuinely carries the structure, a fire that destroys the interior can leave the walls standing and sound. That is a materially different position from a total loss, because the shell removes the demolition cost and can support a rebuild constructed inside it.

The mistake buyers make from outside the region is treating any burned building as a teardown. On this stock that can be badly wrong in the seller's favour, and it is worth establishing before anyone prices anything.

How Do I Tell Whether My Walls Are Load-Bearing?

Thickness at a window or door reveal is the usual quick indicator, since a solid wall is substantially deeper than a veneer. A structural engineer confirms it and also says whether the fire compromised it, and on this stock that report frequently pays for itself several times over.

Demolition Is Not Simple Here

Buildings that share walls cannot be removed in isolation. Before issuing a permit to wreck a structure having one or more party walls, the director takes specified steps, and whoever demolishes carries the obligation to leave the neighbouring structure sound and weathertight.

That has two consequences. It raises the cost of the teardown route, which reduces what a buyer clearing the site can pay. And it makes the repair route comparatively more attractive, because repair keeps the wall in place and avoids the obligation.

Does That Make My Building Harder to Sell?

It narrows the field of buyers toward those who understand the stock, and it does not necessarily reduce the price. A surviving masonry shell in this part of the city can be worth more to a rehabber than a cleared lot is to a builder, which is the reverse of the usual arithmetic.

We publish no structural conclusions or party wall determinations for individual Over-the-Rhine buildings. Both depend on inspection and on the particular attachment, and neither is something a website can settle.

The Escrow Question Applies With Force

Where a fire loss reaches sixty per cent of aggregate policy limits, section 3929.86 diverts proceeds to the city, held as security against removal, repair or securing. On buildings of this age and value the threshold is crossed easily.

An owner intending to sell rather than restore should know about the contractor's estimate route, which returns the fund above the estimated cost of the work without the work being done, provided the city has not started it. The full position is on our page covering the fire escrow.

Over-the-Rhine in Context

Where comparable older masonry sits on larger lots, see our page about Walnut Hills and the east side. Where the stock is more often frame, see our page for Northside and the Mill Creek valley.

The Numbers Behind an Attached Masonry File

Section 3929.86 was enacted in 1980 and amended in 1987, 1992 and 2015. It bites when the agreed loss reaches 60 per cent of aggregate policy limits, and the fund returns within 60 days of the required proof reaching the designated officer.

If the building is ordered vacated, the licence fee falls due within 30 days, liability insurance within 30 days, and the property must meet a 13 point set of maintenance standards before the licence is issued. The annual fee reaches $2,700 at two years and $3,500 at five.

Over-the-Rhine Questions

The Walls Are Still Standing. Is That Good?

On genuinely load-bearing masonry, yes, and it can be worth a great deal. Get it assessed before accepting an offer priced as a teardown.

My Neighbour's Building Was Affected.

Common with shared walls and it needs handling properly. Both insurers will have an interest and the party wall obligations run in both directions.

Will You Buy an Attached Masonry Building?

Yes. Party wall work is a cost we price rather than a reason to decline, and we will tell you when a rehabber would pay more.
